1. Operator Information and Scope of Agreement

Gibbr is operated by the AgentPay Team, led by Shawn Lippert, located at 95b Havasupai St, Grand Canyon, AZ 86023, United States. You can reach our support team by emailing support@gibbr.app with any inquiries. These Terms of Service set out the binding legal agreement between you and the operator for using our platform.

These terms apply whenever you visit gibbr.app, use our Android application wrapper, or interact with any feature, chat room, or QR code service we provide. By accessing or using Gibbr, you agree to comply with these terms in full. If you do not agree, you must stop using our platform immediately.

We wrote this agreement in plain English so that venue owners, trail rangers, tour guides, and travelers can clearly understand their rights and duties. We avoid artificial legal jargon while maintaining a legally binding structure that protects both you and our platform.

2. The Gibbr Translation Service

Gibbr provides multi-channel machine translation tools designed to bridge language barriers across community discussions, direct personal conversations, business interactions, and emergency situations. All platform features are accessible through gibbr.app and our Android app wrapper.

Our platform hosts translation chat rooms categorized by country, region, and topic. Every message posted in a room is automatically translated into the preferred language of each participant. This allows international groups to converse naturally in real time without language barriers.

For face-to-face spoken interactions, our translator tool at gibbr.app/talk allows two people to share a single phone screen. Each participant speaks their native language into the device, and the app transcribes, translates, and speaks the output aloud for the listener.

We offer voice notes at gibbr.app/voice/ as a paid Premium feature for fast voice communication. You hold a button and speak your message, and the recipient reads the translated text in their language while hearing it spoken aloud. Each user receives a unique short code, such as SHAW-0765, allowing others to contact them directly.

Gibbr produces printable QR cards that connect physical locations to translated digital conversations. We offer venue QR cards for hotels, clinics, markets, and tour desks, as well as $5 per year personal QR cards for market stalls, taxi drivers, guides, and spare rooms. Scanning a card opens a translated chat directly with that person or desk.

Our Emergency SOS feature at gibbr.app/sos allows individuals facing danger to send a distress message in their native language. The platform translates the alert, triages its severity, and routes it to a subscribing emergency response agency whose coverage area contains the user's location.

3. CRITICAL EMERGENCY SOS DISCLAIMER

IMPORTANT SAFETY WARNING: GIBBR EMERGENCY SOS IS NOT A REPLACEMENT FOR 911 OR ANY OFFICIAL LOCAL EMERGENCY NUMBER. If you are in immediate physical danger or face an emergency, you should call 911 or your local official emergency telephone number first whenever possible.

The operation of Gibbr Emergency SOS depends entirely on factors beyond our control, including your phone hardware, battery power, cellular or Wi-Fi connectivity, and accurate GPS signals. Furthermore, alert delivery requires that an official emergency agency in your area maintains an active subscription and actively monitors incoming alerts.

Message delivery, transmission speed, and emergency response times are never guaranteed under any circumstances. Gibbr provides software infrastructure to route translated alert information, but our operator does not manage dispatch centers, operate rescue teams, or provide physical rescue services.

Subscribing emergency agencies, such as park rangers, county sheriffs, ski patrols, and search and rescue teams, pay for coverage access and operate according to their own independent dispatch protocols. Gibbr routes incoming distress information to these agencies but exerts no control over their response decisions or arrival times.

While sending an Emergency SOS distress alert is free of charge for individuals in trouble, sending false, fraudulent, or prank distress alerts is strictly prohibited. Submitting improper SOS alerts impairs emergency routing capacity and will result in immediate account termination.

4. Machine Translation Performance and Operational Privacy

Automated machine translation is a valuable communication tool, but users must recognize that translation technology is inherently imperfect. Language nuances, local dialects, regional slang, background noise, and specialized terminology can lead to translation inaccuracies.

You must never rely solely on Gibbr machine translations for medical treatment decisions, legal agreements, official compliance, or safety-critical instructions without obtaining independent human verification. You accept all risks associated with relying on automated translation output during your communications.

As a fundamental privacy feature, all speech recognition, text translation, and voice synthesis operations run entirely on servers controlled directly by the operator. Your message content, voice recordings, and translations are never sent to, processed by, or shared with third-party AI vendors such as OpenAI, Google, or Anthropic.

5. Acceptable Use and Community Rules

To maintain a safe environment, you agree to use Gibbr strictly for lawful purposes and in accordance with these rules. You are solely responsible for all text, voice audio, photos, and messages submitted through your account.

You agree that you will not engage in prohibited activities on our platform during your communications. Please review the prohibited actions list below before using our features:

Automated moderation tools analyze public chat room messages to detect policy violations and hide abusive content. Additionally, profile photos uploaded by users are scanned automatically by an image-recognition model to filter out prohibited material. Accounts that violate these acceptable use rules may be flagged or suspended without prior warning.

6. User Accounts, Short Codes, and Age Restrictions

When creating your Gibbr profile, you select a display name and your primary language, and our system generates a unique short code for your account, such as SHAW-0765. This short code enables other users to connect with you without revealing your private contact information.

To keep you signed in across visits, we store your short code and a secure login secret in your web browser's local storage. You are responsible for keeping your device secure and maintaining the confidentiality of your account credentials.

Gibbr is not intended for use by children under 13 years of age. We do not knowingly collect personal details from children under 13, and any account identified as belonging to an underage child will be closed or restricted.

Our platform includes adult-only chat rooms that are strictly age-gated to shield younger users from mature discussions. Accounts identified as belonging to older minor users are subject to feature restrictions and may require a guardian email address to participate in specific areas.

7. Subscriptions, Pricing, Stripe Payments, and Cancellations

Gibbr provides both free communication tools and paid feature upgrades. Premium voice notes are available for $5 per year, and personal QR cards cost $5 per year for market stalls, taxi drivers, guides, or spare rooms. Venue plans for hotels, clinics, markets, and tour desks are billed monthly or annually and include a 30-day free trial period.

All payment card processing is handled securely by Stripe. The operator never receives, processes, or stores raw credit card or debit card numbers on our servers. Any billing questions or payment assistance requests should be directed to support@gibbr.app.

You may cancel your Premium subscription or venue plan at any time through your account control panel or by emailing customer support. Canceling a subscription stops future automated renewal charges, and your paid access will continue until the end of your current active billing period.

Individual users in distress pay nothing to send Emergency SOS notifications through gibbr.app/sos. Emergency response agencies purchase paid coverage subscriptions to receive, triage, and act upon incoming distress reports originating within their geographic coverage boundaries.

8. Account Suspension and Service Changes

We reserve the right to suspend, restrict, or terminate user accounts that violate these terms, submit fraudulent SOS reports, engage in abusive behavior, or attempt to compromise platform security. Account actions may be initiated automatically by moderation algorithms or manually by operator support staff.

We continuously modify and improve our technology, which means we may add, update, suspend, or remove specific platform features, chat rooms, or tools at gibbr.app or within our Android app without advance notice. We accept no liability for service interruptions, feature alterations, or temporary platform downtime.

We reserve the right to revise these Terms of Service at any time to reflect software updates, operational changes, or legal requirements. Updated terms will be published on gibbr.app accompanied by a revised publication date line. Your continued use of Gibbr after updated terms are published constitutes your acceptance of the revised agreement.

9. Warranty Disclaimers and Limitations of Liability

THE GIBBR SERVICE IS PROVIDED ENTIRELY ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We make no guarantees that platform operations will be uninterrupted, secure, or completely error-free, nor do we promise that machine translations will be fully accurate or that emergency SOS alerts will reach responders without delay. You choose to use Gibbr entirely at your own risk and discretion.

To the fullest extent permitted by law, the cumulative liability of the operator, Shawn Lippert, and the AgentPay Team for all claims, losses, or damages arising out of or relating to Gibbr shall not exceed the total amount you paid to Gibbr in the twelve (12) months immediately preceding the event giving rise to liability. If you have paid no fees to Gibbr in the preceding twelve months, our total aggregate liability is limited to five dollars.

10. Governing Law and Dispute Resolution

These Terms of Service and any legal claims, disputes, or causes of action arising out of or related to Gibbr shall be governed by and construed under the laws of the State of Arizona, United States, without regard to its conflict of law principles. This choice of law applies regardless of your physical location or residency.

You agree that any legal lawsuit, court action, or administrative proceeding relating to Gibbr shall be filed exclusively in the state or federal courts located within the State of Arizona. You irrevocably submit to the personal jurisdiction and venue of these courts for all legal proceedings.

Before filing a formal legal claim or lawsuit, you agree to contact us directly at support@gibbr.app to attempt an informal resolution. Most inquiries, billing concerns, and platform misunderstandings can be resolved efficiently through direct dialogue with our operator team.
